Despite Josi being injured on the play, as well as the hit being illegal, Downie won’t be suspended.

Ask any NHL fan to sum up the league’s disciplinary board in one word, and they will say “inconsistent.” The game pledges it is trying to do everything it can to make the game safer, yet plays like this one go unpunished.
Oh well, it wouldn’t be hockey season without inconsistent justice.
